THE PLAIN DEALER, SATURDAY, MARCH 27, 1993- Girls' admitting of plot to be used in trial By KAREN HENDERSON PLAIN DEALER REPORTER Statements made at the Lorain police station by two junior high school girls accused of plotting to kill a teacher can be used in trial, a judge ruled yesterday. Lorain County Juvenile Court Judge Joseph Zieba threw out earlier statements given to a police officer who questioned the girls at Irving Middle School before bringing them to the police station. Zieba said yesterday he would allow the statements taken at the police station to be used in court because they were made after the girls were read their rights. Zieba's decision, which came after a closed hearing, could bolster the prosecution's case. Lorain police have said the girls admitted at the station that they had planned to kill their teacher with a knife.

The two seven ages 12 and 13, were charged with delinquency by reason of conspiracy to commit aggravated murder. The 13-year-old was also charged with possession of a weapon on school premises. Both were arrested on Jan. 20, the day they allegedly planned to stab their teacher. Lorain police said the 12-year-old was to hold the teacher and the Lorain boy, 9, hit after running in front of van LORAIN A 9-year-old Lorain boy was in stable condition yesterday after being hit by a flower delivery van after school Thursday.

Lamonte A. Phillips of Meister Rd. suffered head and pelvis fractures and a bruised lung after the accident at 4:20 p.m., according to Eileen Caruso, a spokeswoman for Rainbow Babies and Childrens Hospital in Cleveland. The van driver, Cornelius Jancsura, 67, of Lorain will not, be charged in the accident, said Les George, Lorain's traffic commissioner. Lamonte, a pupil at Masson School, got off the school bus with his 10-year-old cousin, Derrick Wren, at a stop on W.

Erie St. in Lorain. The substitute bus driver did not know that it was not their stop, George said. "He just wanted to get home before the bus got to his bus George said. After the bus left, the boys decided to cross the four-lane highway at 5000 W.

Erie St. They crossed the westbound lanes and stopped at the middle yellow line. A car in the left, eastbound lane stopped to let the boys cross. Lamonte ran in front of the van in the curb lane and Jancsura was not able to stop, George said. Lamonte's head hit the van's left headlight and he rolled over to the side of the road.

Jancsura was driving 30 mph to 35 mph. Lamonte was taken to Lorain Hospital and then to Rainbow. "There was no way anyone should have been crossing there," George said. 13-year-old was to stab her with a 12-inch knife used to fillet fish. Detectives said 10 to 15 classmates placed bets totaling $200 on whether the girls would carry out the plan.

No other students have been charged. Police said the plot was hatched after the older girl was admonished in class for not paying attention. The plot was foiled when Assistant Principal Jacqueline Greenhill, who had heard rumors of the plot, came to the classroom about 15 minutes before the stabbing was to occur, police said. Zieba has set the trial for April 1. if convicted, the girls could be placed in the custody of the Ohio Department of Youth Services until age 21.
